TERMS OF USE

ScreenBroidery, LLC dba Thumbprint – Company Store Terms of Use

1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of the Store operated by ScreenBroidery, LLC dba Thumbprint (“Thumbprint,” “we,” “us,” or “our”).
By accessing or using the Store, you agree to be bound by these Terms. If you do not agree, you may not use the Store.

2. Relationship of the Parties

The Store may be branded for or associated with a third-party organization (“Client”).

Thumbprint operates the Store as an independent third-party service provider.

• Thumbprint is not owned by or affiliated with the Client
• The Client is not the seller of goods or services offered through the Store
• All transactions are conducted, processed, and fulfilled by Thumbprint

No partnership, joint venture, agency, or employment relationship is created between Thumbprint and the Client by virtue of the Store.

3. Eligibility and Use

You represent and warrant that:

• You are at least 18 years of age or using the Store under supervision
• All information you provide is accurate and complete

You agree not to:

• Use the Store for unlawful purposes
• Interfere with or disrupt the Store or its systems
• Attempt unauthorized access to any portion of the Store

Thumbprint reserves the right to suspend or terminate access at its sole discretion.

4. Orders and Payment

• All purchases are made from Thumbprint
• Payment processing is handled through third-party providers
• Orders are subject to acceptance and availability
• Thumbprint reserves the right to cancel or limit orders at its discretion

5. Product Information

We make reasonable efforts to ensure accuracy of product descriptions, pricing, and images; however:

• Variations may occur
• Product descriptions may incorporate third-party or AI-generated content
• Availability and pricing are subject to change without notice

6. Shipping and Fulfillment

• Orders may be fulfilled from multiple facilities and may ship separately
• In-stock items typically process within 1–3 business days
• Made-to-order items may require 7–10 business days for production
• Estimated delivery timeframe is 5–14 business days

All delivery dates are estimates and not guaranteed.

7. Returns and Refunds

• Returns must be requested within 30 days of delivery unless otherwise specified
• Items must be unused and in original condition
• Custom or personalized items are not eligible for return
• Return shipping fees may apply

Refunds will be issued to the original method of payment.
Exchanges are not provided; new orders must be placed.

8. Intellectual Property and Branding

All content on the Store is owned by Thumbprint or its licensors.

Client trademarks and logos:

• Are used under license or permission
• Do not indicate ownership or operation of the Store by the Client
• Do not create any affiliation beyond a contractual relationship

9. Disclaimer of Warranties

The Store and all products and services are provided on an “as is” and “as available” basis.
Thumbprint disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

10. Limitation of Liability

To the fullest extent permitted by law, Thumbprint shall not be liable for:

• Indirect, incidental, or consequential damages
• Delays or failures caused by shipping carriers or third parties
• Losses arising from use of the Store

11. Indemnification

You agree to indemnify, defend, and hold harmless Thumbprint from any claims, damages, or expenses arising from:

• Your use of the Store
• Your violation of these Terms
• Your infringement of any rights of a third party

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to conflict of law principles.

13. Modifications

Thumbprint reserves the right to modify these Terms at any time. Updates will be effective upon posting. Continued use constitutes acceptance of revised Terms.
